What is a mechanic's lien?

A mechanic's lien is a legal claim recorded against real property to secure payment for labor or materials supplied to that property by a contractor, subcontractor, or supplier.

A mechanic's lien is a security interest attached to a specific piece of real property. When a contractor, subcontractor, or supplier is not paid for work or materials they provided to that property, they can file a lien that becomes part of the public record on the title. The lien creates a cloud on ownership: the property cannot be sold or refinanced without addressing the outstanding claim, which is the practical leverage that motivates payment.

The filing process is highly state-specific. Most states require the claimant to serve a preliminary notice early in the project, then file the lien within a fixed window after the last day of work — typically 60 to 120 days, though the exact deadline varies. Missing any step, including the preliminary notice, can permanently waive the lien right even on a legitimately unpaid balance. Lien rights are one of the few collection tools that expire automatically if not used on time.
