What is debt validation under the FDCPA?
Debt validation is a debtor's legal right — under the FDCPA — to request written verification of a debt from a third-party collector, who must pause collection activity until the verification is provided.
Under the Fair Debt Collection Practices Act, a consumer who receives an initial collection notice has 30 days to send a written debt validation request. When a valid request arrives, the third-party collector must stop collection efforts and provide written verification — typically the original creditor's name and the amount owed — before resuming contact.
Debt validation is a right against third-party collectors specifically. A first-party creditor collecting their own invoices is generally not subject to the same FDCPA validation requirement, though some state laws apply similar rules more broadly.
