Bad check (NSF) demand letter — formal written demand after a returned check
When a customer's check is returned for non-sufficient funds, most US states give you the right to send a formal demand for the face amount plus statutory damages and fees. Sending this letter by certified mail is typically required before the statutory remedies apply.
Use it for
- Service businesses that received a check that was returned NSF
- Situations where you want to preserve statutory bad-check remedies (treble damages in some states)
- Cases where the customer has not responded to an informal request for replacement payment
- Any balance large enough to warrant certified-mail documentation
Do not use for
- ACH or card payment failures — use a standard demand letter instead
- Situations where you have already negotiated a replacement payment schedule
- Checks that were returned for reasons other than NSF (e.g., stop-payment orders — different legal framework)
